A QDRO (often referred to as a “Quadro”) is a special document required to divide pension, retirement and profit sharing plans (e.g. 401k, SEP, ESOP, etc.) as part of a property settlement in a divorce or legal separation. The QDRO may be prepared while the divorce or legal separation proceedings are in process or after the court has entered the final decree or order.
In addition to requiring court approval, the QDRO must conform to the requirements of the Plan. Although there are certain elements that should be included in most QDROs, many pension retirement plans have their own unique requirements and language that must be included in order to obtain Plan approval. Thus preparing the legal document is frequently tedious, time-consuming and complicated. As each QDRO must be customized to meet Plan requirements, it is often very expensive to obtain the expertise required to prepare correct paperwork.

What is a Qualified Domestic Relations Order?
  • A qualified domestic relations order is a judgment, decree, or order (including the approval of a property settlement agreement) that is made pursuant to state domestic relations law (including community property law) and that relates to the provision of child support, alimony payments, or marital property rights for the benefit of a spouse, former spouse, child, or other dependent of a participant.
A state authority, generally a court, must actually issue a judgment, order, or decree or otherwise formally approve a property settlement agreement before it can be a domestic relations order under ERISA. The mere fact that a property settlement is agreed to and signed by the parties will not, in and of itself, cause the agreement to be a domestic relations order.
